Terms of Service
Paper Trail does not issue title opinions, title insurance, or legal advice. The Service produces working papers that assist a licensed title examiner, abstractor or attorney. The professional using the output remains the professional of record and is solely responsible for every determination made about title.
1. What the Service is
The Service ingests recorded land records supplied by you, applies automated optical character recognition, classification, extraction and rule-based analysis, and returns an examination file identifying facts found in those documents together with the page and location each fact came from.
The Service reports what it found. It does not determine marketability, insurability, or priority, and it does not certify that a search was complete.
2. What the Service is not
- It is not a title search, abstract of title, title commitment, or title opinion.
- It is not legal advice, and no attorney-client relationship arises from its use.
- It is not a substitute for examination by a qualified professional.
- It does not detect matters that are not present in the documents you supply. A substantial share of title defects — including fraud, forgery, undisclosed heirs and off-record interests — are not discoverable from recorded documents at all.
3. Your responsibilities
You are responsible for sourcing the documents examined, for the legal right to supply them, for reviewing all output before relying on it, and for any determination, commitment or policy you issue. You must not present Service output to a third party as a completed title search or opinion.
4. Data handling
Documents you upload are processed using third-party cloud services — currently Amazon Web Services (optical character recognition) and Anthropic (analysis). Recognised text is encrypted at rest. Retention is configurable per tenant. Social security numbers and dates of birth are detected by presence only and are not stored. Full detail is in the Privacy Notice.
Paper Trail is not itself certified under SOC 2 or any comparable framework. Statements about the certification status of our subprocessors describe those subprocessors, not Paper Trail.
5. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR COMPLETENESS. Automated extraction and analysis are imperfect. Output may contain errors, omissions and misreadings, including on documents that appear to have been read correctly.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPER TRAIL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE, UNDER ANY THEORY, SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS.
PAPER TRAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, CLAIMS UNDER A POLICY OF TITLE INSURANCE, OR CURATIVE COSTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Indemnity
You agree to indemnify and hold Paper Trail harmless from claims arising out of your use of the Service, including any determination you make, any document you issue, and any representation you make to a third party about Service output.
8. Beta
The Service is in private beta. Features may change or be withdrawn, and availability is not guaranteed.
9. Changes
These terms may be updated. Material changes will be reflected in the effective date above.
